Galvin Disqualified

Greyhound Racing NSW stewards have concluded an inquiry into the analysts’ reports that the urine sample taken from Thief At Night after that greyhound had won Race 1, the Kancool Meats Maiden, run at Gunnedah on 8 November 2014, had been analysed and found to contain the prohibited substances amphetamine, 4-hydroxyamphetamine a metabolite of amphetamine, ritalinaic acid, and dexamethasone.

Evidence at the inquiry was taken from Thief At Night’s trainer Daniel Galvin and Dr Adam Cawley from the Australian Racing Forensic Laboratory (ARFL). Written evidence was tendered from the ARFL and Racing Analytical Services Victoria.

Mr Galvin could offer no explanation to the inquiry as to the detection of the prohibited substances.

Mr Galvin pleaded not guilty to a charge under Gar 83(2)(a) in that he was responsible for the presentation of Thief At Night for the race in question other than free of prohibited substances in that the post race urine sample taken from the greyhound was found on confirmatory analysis to contain the prohibited substances amphetamine, 4-hydroxyamphetamine,ritalinic acid, and dexamethasone.

After consideration of the evidence Mr Galvin was found guilty as charged.

Mr Galvin was disqualified for a period of three years.

In determining penalty, stewards took into consideration Mr Galvin’s unblemished 13 year period of registration, his voluntary work for the Muswellbrook Greyhound Racing Club, a letter of reference from the Muswellbrook Greyhound Racing Club, the not guilty plea, the nature and reported high levels of the prohibited substances inclusive of two Schedule 8 drugs, the wagering support for Thief At Night, Mr Galvin’s inability to provide stewards with a satisfactory explanation for the finding of the prohibited substances, and the need for the penalty to act as a deterrent.

Thief At Night was disqualified from the race in question and the placings amended accordingly.

Mr Galvin was advised of his right of appeal.
